Consumer Use Policy

1. Who This Policy Applies To

This policy applies to individual users who access Kodus for:

• Personal projects and side projects not operated as a business;
• Self-directed learning, study, and skill development;
• Contributions to public open-source projects in a personal capacity;
• Evaluation of Kodus on the free tier prior to deciding whether to subscribe.

If your use falls within the definition of Commercial Use in the Commercial Use Policy, that policy applies instead.

2. Free-Tier and Hobbyist Use

Where a free tier is offered, it is provided so that individuals can learn, experiment, and build personal projects. The free tier is subject to published usage limits (for example, token caps, concurrency caps, and hosted-workspace limits), which we may change from time to time. The free tier is not a grant of commercial rights.

3. Minimum Age

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to create a Kodus account and use the Services on your own behalf. If you are located in the European Economic Area and under the age of sixteen (16), you may not use the Services without verifiable consent from a parent or legal guardian as required by Article 8 of the GDPR, and we may decline to process such use absent appropriate consent.

4. Single User, No Account Sharing

Kodus accounts are personal and single-user. You shall not share your credentials, API keys, relay tokens, or authenticated sessions with any other person. If more than one person needs to use the Services, each person must register a separate account (subject to the rules on Commercial Use for teams and organizations).

5. Compliance with the AUP

Consumer Use is subject to the full Acceptable Use Policy. In particular, consumer users shall not use the Services to generate malware, attempt unauthorized access to third-party systems, circumvent rate limits, generate prohibited content, or re-host Kodus capacity as a competing service.

6. Ownership of Your Code

You retain ownership of the code and other output produced at your direction by the agent, subject to the terms of any third-party license or AI Model Provider policy applicable to model outputs. You are free to open-source, publish, or personally use that code, provided your use is consistent with the Terms of Service and applicable law.

7. Transition to Commercial Use

If your usage evolves beyond personal, hobbyist, or non-commercial use (for example, you begin to monetize a side project, accept paid work using Kodus, or invite collaborators), you are required to transition to a paid plan appropriate for Commercial Use. Continuing to rely on the free tier for such activity is a violation of this policy and of the Commercial Use Policy.

8. Privacy

Our Privacy Policy and Data Use Policy apply in full to consumer users. In particular, prompts and selected workspace content you submit to the agent are routed to third-party AI Model Providers on a per-request basis under those providers' data-processing terms; we do not use your prompts or workspace content to train foundation models.

9. Fair-Use Enforcement

We reserve the right to throttle, rate-limit, or suspend individual consumer accounts that generate abusive load, interfere with the Services, or appear to be used in a way inconsistent with this policy. Where appropriate, we may contact you to understand your use and, if it is in fact Commercial Use, assist you in upgrading to an appropriate paid plan.

10. Questions and Changes

If you are unsure whether your use is covered by this Consumer Use Policy or the Commercial Use Policy, please contact us. We may update this policy from time to time; continued use after a material change constitutes acceptance of the updated policy.
