1. Nature of the Services

The Kodus platform is a developer tool. It consists of a cross-platform command-line interface, a relay backend, a web dashboard, and integrations with third-party AI Model Providers. The platform produces and executes code, shell commands, and tool calls in environments you authorize. It does not, and cannot, substitute for the judgment of a qualified human software engineer.

2. AI Output May Be Incorrect, Incomplete, or Insecure

Output generated by the agent, including source code, shell commands, configuration, documentation, explanations, and refactor suggestions (collectively, "AI Output"), is produced by statistical models operated by third parties. AI Output:

• May be factually incorrect, outdated, or internally inconsistent;
• May reference APIs, libraries, or language features that do not exist ("hallucinations");
• May introduce security vulnerabilities, including unsafe shell invocations, injection flaws, credential leaks, or insecure cryptography;
• May infringe third-party intellectual property or fail to comply with open-source license obligations;
• May delete, overwrite, or corrupt files, commits, or other state;
• May behave non-deterministically between runs even when given the same prompt.

3. Your Responsibility to Review

You are solely and exclusively responsible for reviewing AI Output before relying on it, committing it, running it, shipping it, or deploying it. You must read generated code, understand generated commands before approving them, and run independent tests in environments you control. Kodus is not a substitute for code review, static analysis, security review, quality assurance, or professional engineering judgment.

4. No Warranty of Fitness

Kodus makes no representation or warranty that AI Output or the Services are fit for any particular purpose, will meet your requirements, will be compatible with your other systems, will be free from defects, or will produce any particular commercial, scientific, or creative result. The Services are provided "AS IS" and "AS AVAILABLE" as further described in the Terms of Service.

5. No Professional Advice

Nothing produced by Kodus is legal, financial, tax, medical, safety-critical-engineering, or other professional advice. If the agent is asked about such topics, its output is informational only and should not be relied upon as a substitute for advice from a qualified professional in your jurisdiction.

6. No Uptime Guarantee

The Services may be interrupted, degraded, throttled, or temporarily unavailable due to scheduled maintenance, infrastructure incidents, AI Model Provider outages, rate-limit enforcement, plan-gating, or abuse mitigation. Except where expressly stated in a separate written agreement, Kodus does not commit to any uptime percentage, response time, or availability window for the Services.

7. Execution in Your Environment

When the agent executes shell commands, edits files, or performs git operations, those actions occur in a working directory you have authorized. Kodus is not liable for any loss of data, damage to systems, unintended commits, disclosure of secrets, or other harm caused by agent actions in your environment. Any sandboxing, command-filtering, or safety-layer features are best-effort and must not be treated as the sole barrier between the agent and sensitive systems.

8. Third-Party AI Model Providers

The Services route requests to AI Model Providers including Anthropic, OpenAI, Google, and similar services. Kodus is not responsible for the output, availability, pricing, or policies of those providers, and makes no warranty regarding their models or their handling of your content beyond what is represented in the Privacy Policy and Data Use Policy.

9. No Waiver of Consumer Rights

Nothing in this Disclaimer is intended to limit any non-waivable right you may have as a consumer under applicable law. To the extent that any provision of this Disclaimer conflicts with a non-waivable consumer right, that right prevails to the minimum extent required by law.

10. Incorporation and Precedence

This Disclaimer supplements and is incorporated into the Terms of Service. In the event of a conflict, the Terms of Service govern except where this Disclaimer is more specific about AI Output and agent execution.
